Terms & Conditions

Introduction

These Terms and Conditions constitute a legally binding contract between the customer (“you”) and MSVK Pty Ltd (“MSVK,” “we,” “our” “seller” or “us” ) and apply to the ordering purchase, fulfillment, and delivery of goods (“Goods”).  You agree to these Terms and Conditions, whenever you place an order for Goods from us.

These Terms and Conditions constitute the entire Contract between us and you for the supply of goods. Therefore, please read the following Terms and Conditions carefully before placing your order. The Contract cannot be changed unless we agree to the changes in writing or by email.

Prices

Prices displayed on this website are in Australian Dollars ($AUD) and, where applicable, are inclusive of GST. Our website Prices and offers are subject to change without notice. Buyer shall not have any right to set off any amounts due hereunder against any amounts which may become payable to Seller under any other agreement.

Payment

We currently accept PayPal, Internet bank transfer, Direct Deposit payment only. We will process the payment only when we receive all the required information. Orders placed on a weekend or a Public holiday will be processed only on the next business day. (Monday through Friday, excluding NSW Public holidays). We reserve the right to cancel the transaction, If payment is not received within 7 days from the date you place your order.

Shipping

We sell and ship products within Australian territories only. We send items to your registered address only, hence, please make sure your postal address is correct before check out. All items will be dispatched within 24 hours when full payment is received from you and confirmed. Allow up to 10 working days for items to be delivered from the date your payment is confirmed. All delivery dates are estimated unless otherwise agreed in writing signed by an officer of the Seller. Seller shall use its reasonable efforts to deliver all products within the specified time. However, in no case shall Seller be liable for any expense, loss, or damage whatsoever suffered by the buyer due to the Seller’s failure to deliver Product by the specified date.

Transportation and Risk of Loss

The shipment methods and routes are at the Seller’s discretion unless the Buyer sends explicit instructions otherwise, which is agreed by the seller. Title to the goods passes to the Buyer when Product is delivered to the selected carrier, even if Seller makes a nonconforming tender or buyer attempts to revoke acceptance of the Product or repudiates this document after the Products have been identified hereto.

Cancellation Or Modification

Buyer may cancel any order placed with and accepted by Seller only upon Seller’s approval in writing signed by an officer of Seller and upon terms that indemnify Seller against any loss. Suppose we cannot stop the shipment of the order at the time of cancellation, you will be required to refuse delivery or return the products to receive a refund as per Our Refund Policy. Seller reserves the right to charge an administration fee to cover reasonable costs for your cancelled order.

Warranty And Disclaimer

We provide a warranty against defects in materials and the quality of our products. We will repair or replace the product if it does not perform as specified due to defects in parts or quality. In no event does this warranty extend to instances where the product is damaged through uses for which it was not intended, misuse, mishandling, removal and re-installation, neglect, accident, or tampering. In no event shall we be liable for any indirect, incidental, or consequential damages arising from this product or the performance or breach thereof, even if we have been advised of the possibility thereof. If any, the seller’s liability to the customer, shall in no event exceed the total of the customer’s purchase price. Any representations or promises inconsistent to or in addition to this warranty are unauthorized and shall not bind us (Seller).

Limitation Of Liability

Buyer acknowledges and agrees that seller’s liability for any claims concerning the products shall not exceed the amount paid by buyer for the products under the invoice. Such limitations on the seller’s liability hereunder shall apply even if the seller’s liability is due in whole or in part to its negligence. Any action by or on behalf of Buyer or its successors or assigns for breach of this document must be commenced within one (1) year after the cause of action has accrued.

Return & Refund

We can offer a full refund if you change your mind and return the item within 30 days (postage is not refundable). The returned item must be in its original condition. Please check our Warranty & Return Policy for details.

General

We reserve the right to amend these Terms and Conditions at any time. Any amendment will take effect from the time that it appears on the Website. The Terms and Conditions that apply when you place your Order are the Terms and Conditions that will apply to your Order.

The Terms and Conditions, and the use of the Site(s) and any contents thereof, shall be governed by and construed as per the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
